Cases We Have Funded

Public examples of cases we have funded include:

PEPPERWOOD MEWS
A claim involving structural and weather tightness defects on behalf of a body corporate in Auckland and its over 30 owners. The claim alleged negligence in respect of defendants Auckland Council and Housing New Zealand. The claim was successfully resolved prior to trial.

WALKER v FORBES
A large insolvency claim arising out of the collapse of the Property Venture Limited group of companies, based in Christchurch and Queenstown. The claim of negligence and breach of director’s duties, and negligence by the auditors, PWC, was brought by the liquidator. The claims took over 6 years to resolve and required the briefing of overseas based experts. The claims were successfully resolved prior to trial.

THE KIWIFRUIT CLAIM
A claim alleging negligence by the Crown in respect to its border security role. The plaintiffs are 212 kiwifruit growers and post-harvest operators and has been taken as a representative (class) action. By value this is one of the largest claims currently before the courts. While the claim is ongoing, the High Court has determined that the Crown owed a duty of care to the kiwifruit growers and breached that duty of care when it failed to follow its own regulations and permitted the introduction of the Psa bacteria into New Zealand, devastating the kiwifruit industry.

Since 2010 LPF has funded to completion 15 cases. To date we have successfully funded ALL our cases, achieving awards for plaintiffs of over $100m.
